Abstract
The Court for the Defense of Free Competition (TDLC), in an unprecedented ruling, determined that the National Electric Coordinator (CEN) engaged in anti-competitive conduct during a bidding process for expansion works of the national transmission system, ordering it to pay a fine. The ruling determined that, although the Coordinator is not an administrative body, it acts as an independent agency that carries out activities of public interest and, as such, must be subject to oversight. This pronouncement challenged the Coordinator's—until then—unshakeable autonomy and independence, reopening the debate on the judicial and administrative control exercised over regulatory agencies and on the limits of their technical discretion. This article outlines the main differences between transmission works tenders and tenders for goods and supplies; it lists the mechanisms that could serve as controls against the Coordinator's actions; The most relevant jurisprudential trends in safeguarding free competition in bidding procedures will be described; and finally, the TDLC's jurisdiction to judge the Coordinator's technical discretion will be analyzed, in light of the legal dispute mentioned at the beginning, which remains ongoing.
